INTRODUCTION

 

Welcome to J Music & Sound. This website (www.jmusicsound.com) and all related services are owned and operated by JJ Creative Inc., a New York corporation doing business as J Music & Sound (collectively referred to as the "Company", "we", "us", or "our").

By accessing our website and subscribing to our service, you agree to be bound by the following Terms of Service. These terms constitute a legal agreement between you ("Licensee") and the Company, an independent record label and professional music licensing provider.

1. THE SERVICE (24/7 COMMERCIAL RADIO)

​

J Music & Sound operates an official record label and a proprietary, DJ-free 24/7 radio streaming platform. We provide high-quality, curated music streams designed as a legal, all-in-one background audio solution for commercial environments. Your subscription grants you the legal right to perform our proprietary catalog within your designated physical business location.

2. CORE LICENSING RULES (TL;DR)

​

To ensure your business remains legally protected under U.S. Copyright Law, you must adhere to these four essential rules:

  • Rule 1: ACTIVE SUBSCRIPTION ONLY – Your legal right to perform our music ends immediately if your subscription lapses, is canceled, or remains unpaid.

  • Rule 2: AUTHORIZED CHANNELS ONLY – Music must be performed exclusively via the J Music & Sound web player or Company-authorized physical media (USB).

  • Rule 3: NO 3RD PARTY PLATFORMS – Using our YouTube, Spotify, or Apple Music channels for commercial public performance is STRICTLY PROHIBITED and will void your license.

  • Rule 4: SINGLE LOCATION – Each subscription covers one (1) physical business address. Separate subscriptions are required for additional branches or locations.

3. GRANT OF LICENSE

Subject to an active subscription, J Music & Sound grants a limited, non-exclusive, non-transferable, and revocable license for the public performance of our music. This license is intended solely for background ambient use at the licensed location. No ownership, title, or intellectual property rights are transferred to the Licensee.

4. OWNERSHIP & INTELLECTUAL PROPERTY

​

J Music & Sound is the sole owner and controller of all master recordings, compositions, and copyrights within its catalog. Any recording, reproduction, redistribution, or unauthorized "ripping" of the 24/7 stream is a violation of federal law and this Agreement.

5. MONITORING & COMPLIANCE

​

J Music & Sound reserves the right to monitor usage and verify compliance with this Agreement through reasonable technical tracking. Any misuse or unauthorized access may result in immediate termination of service and legal action.

6. CANCELLATION & REFUND POLICY

  • Subscription: All digital sales are final. We do not provide pro-rated refunds or credits for partial-month usage.

  • Access: Upon cancellation, your license remains valid only until the end of the current paid billing cycle.

  • Physical Media (USB): Refunds for USB media are subject to our separate Return Policy and are non-refundable once the seal is broken or the content is accessed.

7. COPYRIGHT ENFORCEMENT & DAMAGES

Unauthorized use of our music (including continued use after subscription termination) constitutes copyright infringement under the U.S. Copyright Act (17 U.S.C. § 501). Statutory damages for such violations may range from $750 to $150,000 per infringed work, in addition to legal fees and other remedies.

8. PRO DISCLAIMER

This license applies solely to the J Music & Sound proprietary catalog. It does not replace or substitute any public performance licenses (e.g., ASCAP, BMI, SESAC, GMR) that may be required for music played outside of this catalog.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, J Music & Sound shall not be liable for any indirect, incidental, or consequential damages. Total liability shall not exceed the total subscription fees paid by the Licensee.

10. GOVERNING LAW & JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict of law principles. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the courts located in the State of New York.
